As AI systems shape public governance, their impact on fundamental rights is more critical than ever. In her forthcoming monograph publication, Dr. Elif Biber, our Alumna and now a postdoctoral researcher in European Public Law and Digitalisation at the University of Luxembourg, argues the limits of European legal frameworks, including the much-debated EU AI-Act, and examines real-world cases where AI has challenged fundamental rights.
“To meet these urgent challenges, I propose a rights-based inter-legal approach, delving into the theory of inter-legality, integrating leading European Court of Human Rights and European Court of Justice case law on new technologies,” explains Dr. Biber “I also introduce a three-step adjudication model designed to enhance AI governance and rights protection.”
